1) Who we are

OKO Labs Inc. d/b/a PequeBooks makes personalized storybooks and related products.

2) Agreement

By using our website or buying a product, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use our services.

3) Eligibility and accounts

• You must be 18 or older to place orders.
• You are responsible for your account and for keeping your details accurate.
• Upload photos of a child only if you are the parent or legal guardian or you have permission.

4) Prices, taxes, and payment

• Prices exclude taxes, shipping, and fees unless noted.
• You authorize us and our payment processors to charge your payment method for the total shown at checkout.
• You are responsible for all applicable taxes and duties.

5) Orders, production, and shipping

• Personalized items start production shortly after ordering. We may be unable to cancel once production begins.
• Shipping times are estimates. Risk of loss transfers to you when the carrier picks up the order.
• We may refuse or cancel an order for suspected fraud, policy violations, or availability issues. If we cancel after payment, we will refund you.

6) Quality and Reprint Guarantee

• Small color and print variations may occur.
• If your book arrives damaged or misprinted, contact us within 14 days of delivery with photos. Our sole obligation is to reprint and reship the affected item at no extra cost.
• Refunds are not provided for personalized products unless required by law.

7) Returns and withdrawals

Personalized products are made to your specifications and are not eligible for returns or withdrawal, except for the Reprint Guarantee or where required by law.

8) Your content and permissions

• You keep ownership of your photos, names, and other content.
• You give us a limited license to host, process, and create derivative works from your content only to make your illustrations, design your book, fulfill your order, support you, and comply with law.
• We do not use your original photos to train AI models.
• Training and improvement: We may use company generated illustrations (the stylized images our system creates from your photos) to improve and train our models and services. We will not use your original photos for this purpose. Before use, we take steps to remove personal identifiers and to avoid publishing or sharing your child’s identifiable likeness. You can opt out at any time by emailing privacy@pequebooks.com.
• You promise you have the rights to the photos and text you upload and that they do not infringe the rights of others or contain illegal or harmful material.

9) Intellectual property

• Our site, templates, and artwork are owned by PequeBooks or our licensors.
• You receive a personal, non commercial license to use the products you buy. Do not copy, resell, or distribute our designs without permission.

10) Prohibited uses

Do not break the law, upload harmful content, infringe rights, scrape or disrupt our services, or try to bypass security.

11) Privacy

Our Privacy Policy explains what data we collect and how we use and delete it, including uploaded photos.

12) Disclaimers

The services and products are provided “as is” and “as available”. We disclaim all warranties to the maximum extent allowed by law.

13) Limitation of liability

To the maximum extent allowed by law, we are not liable for indirect, incidental, special, consequential, or punitive damages. We are not liable for loss of profits or data or the costs of substitute goods. Our total liability is limited to the greater of the amount you paid for the item or service at issue in the prior 12 months or 100 US dollars.

14) Indemnification

You will defend, indemnify, and hold harmless PequeBooks and our affiliates, officers, directors, employees, and agents from claims and costs, including reasonable attorneys’ fees, arising from your content, your use of the services, your violation of these Terms or law, or your infringement of another’s rights. We may assume exclusive defense. You will cooperate.

15) Force majeure

We are not responsible for delays or failures caused by events outside our control.

16) Changes

We may update these Terms. We will post the new date at the top. Continued use means you accept the changes.

17) Governing law; venue; waivers

These Terms are governed by Florida law. You agree to the exclusive jurisdiction and venue of the state and federal courts in Broward County, Florida. You waive any objection to venue. You waive the right to a jury trial and to participate in class, collective, or representative actions.

18) Assignment and severability

You may not assign these Terms without our consent. We may assign to an affiliate or successor. If a term is invalid, the rest still applies.
